가수 구하라의 이름이 어제 하루 종일 인터넷을 달궜습니다. 이유인즉슨 구하라 씨에게 폭행을 당했다고 구씨를 신고한 전 남자 친구가 있죠. 그 전 남자 친구 알고 보니까 폭행 시비 직후 구하라 씨와의 성관계 동영상을 가지고 '이걸 유포하겠다.' 구씨를 협박하는 일이 있었다는 겁니다. 구하라 씨는 이 협박을 듣고 무릎을 꿇고 삭제해 달라 사정을 했다는데. 남자 친구가 탄 엘리베이터 밖에서 구하라 씨가 무릎을 꿇은 장면이 어제 공개가 되기도 했습니다. 이 뉴스를 보면서 많은 분들이 떠올리셨을 거예요. 바로 리벤지 포르노. 요사이 자주 들리는 용어죠. 헤어진 연인에게 보복하기 위해서 유포하는 성적인 사진, 영상 콘텐츠. 이런 것을 일컫는 말입니다. 리벤지라는 말은 복수. 이런 뜻이죠.

구하라 씨 같은 연예인 케이스뿐 아니라 요즘은 일반인들 사이에서도 연인일 때 찍었던 성관계 동영상을 보복성으로 온라인에 유포해 버리거나 또 협박하는 이런 범죄가 심각한 수준이라는데요. 들어보죠. 한국사이버성폭력대응센터의 사무국장이세요. 리아 사무국장 연결이 돼 있습니다. 사무국장님, 안녕하세요?

◆ 리아> 안녕하세요.

◇ 김현정> 어제 센터에서 입장문도 내셨던데. 구하라 씨 사건 어떻게 보고 계세요?

◆ 리아> 여성 연예인라는 특수한 상황을 이용한 성폭력이라고 보고 있고요. 구하라 씨는 억울하게 폭행범으로 몰렸지만 반박조차 제대로 할 수 없었잖아요. 왜 그럴 수밖에 없었는지를 많은 분들께 알리고자 유포 협박에 대해서 저희가 입장문을 냈고요. 과거에 연예인 성관계 유출 사건이 있었을 때 어떻게 되었나를 보면 영상이 올라가면 사람들이 피해자 입장에서 생각을 해 주기보다는 영상을 다운 받고 시청하면서 가해에 동참을 했었잖아요. 그렇기 때문에 구하라 씨가 그렇게밖에 할 수 없었다고 저는 보고 있고요. 이제는 그런 것들이 바뀌어야 한다고 봅니다.

◇ 김현정> 쌍방 폭행으로 일단 맞고소 상태로 지금 조사가 진행되고 있어요. 구하라 씨가 먼저 때렸는지 남자 친구가 먼저 때렸는지 이건 경찰 조사 결과 드러나겠지만 어쨌든 그 폭행 시비가 붙은 과정 속에서 남자 친구가 동영상, 성관계 동영상을 갖고 협박을 하니까 구하라 씨는 더 이상 적극적으로 이 폭행 사건에 대해 대응하기가 어려워지는 이런 국면이었다는 게 지금 이제 우리한테 드러나고 있는 거죠.

◆ 리아> 네, 그렇죠. 성관계 동영상이 있다는 걸 안 이상은 이제 더 이상 어떤 반박도 할 수 없는 거죠.

◇ 김현정> 그러니까 이게 일반인들은 사실은 (동영상을)보고 나면 '이 사람 피해자야. 이거 어떻게 하지, 이걸 어떻게 신고해 줘야 되지, 어떻게 삭제해야 되지?'가 아니라 보면서 마치 야한 동영상, 야동을 보듯 남들에게 유포하고 특히 그 안에 유명인이 있고 연예인들이 있으면 손가락질을 하는 이런 행위들을 과거에 많이 해 왔어요.

◆ 리아> 사실 이게 리벤지 포르노라고 하지만 이것은 포르노가 아니라 피해를 촬영한 피해 촬영물일 뿐인데 많은 사람들이 그냥 하나의 야한 동영상 정도로만 인식하고 있는 것 같습니다.

◇ 김현정> 그렇죠. 우리가 전에 생각해 보면 여러 가지 사례들을 떠올려요. 그때마다 늘 연예인들이 피해자가 됐고 타격을 받아왔던 것. 구하라 씨도 그걸 알기 때문에 무작정 무릎을 꿇어야 했던 게 아닌가. 이런 생각이 드는데. 성관계 영상을 유포하겠다고 협박했을 경우, 협박했을 경우에는 어떤 처벌을 받습니까?

◆ 리아> 협박죄를 적용을 해가지고 진행을 하거든요. 그런데 저희 센터에서는 이것을 단순한 협박으로 봐서는 안 되고 성폭력으로 봐야 한다고 주장하는 입장이에요.

◇ 김현정> 일반 협박하고 똑같이 다뤄서는 안 된다?

◆ 리아> 네, 그렇습니다. 여성의 경우 섹슈얼리티가 공개되면 어떤 취급을 받는지 아는 사람이 그러한 불평등한 구조를 이용해서 하는 협박이잖아요? 신고하는 순간 유포해버리는 경우가 많아서 이게 협박 자체도 문제지만 피해자분들은 동영상 유포가 더 큰 공포로 다가오니까.

◇ 김현정> 협박을 받아서 내가 신고를 하면 신고가 들어가는 순간 그 동영상 갖고 협박했던 협박범이 유포를 해버려요? 그럼 유포하고 경찰서 들어가요?

◆ 리아> 예, 그런 사례가 있습니다. 그렇게 유포가 한 번 이루어지면 순식간에 퍼질 수가 있고 남자와 여자가 함께 성관계를 해도 여성만 '순결하지 못하다, 더럽다.'라고 비난하는 문화가 있기 때문에 여성분에게는 굉장히 큰 타격이 될 수가 있고 엄청난 공포로 다가올 수 있습니다. 이런 점을 고려해서 불평등한 젠더 위계를 이용한 특수한 범죄로 봐야 됩니다.

◇ 김현정> 바로 이제 그 점 때문에... 이번에 제가 특히 놀란 게 구하라 씨를 대신해서 친한 후배 하나하고 전 남자 친구 최 모씨가 통화를 한 녹음 파일도 공개가 됐어요. 거기에 보면 구하라 씨 후배가 이렇게 얘기합니다. '동영상 보낸 거 이거 협박 아니냐?' 하니까 '나는 협박으로 들어가도 된다. 그러니까 나는 잡혀가도 된다.' 이런 얘기를 태연하게 하더라고요. 결국 이거는 '동영상 유포되면 네가 더 타격이 크겠니, 내가 더 타격이 크겠니. 그러니까 결국 너는 신고 못 할 거야.' 이런 의미가 행간에 깔려 있는 거라고 봐도 될까요?

◆ 리아> 그렇죠. 이게 여성에게 타격이 훨씬 크다는 것을 알고 있고, 어차피 사이버 성폭력으로 현재까지는 그렇게 강한 처벌이 이루어지지 않고 있잖아요? 그리고 구하라 씨는 연예인이기 때문에 영상이 올라가면 사람들이 다 구하라에게만 시선이 집중될 것을 아는 거죠.

◇ 김현정> 그렇기 때문에 신고 못 할 거라는 자신감으로 이런 협박도 이루어진다, 보통 가해자들은?

◆ 리아> 네. 다행히 이 사건은 압수수색이 들어가서 그나마 신고하신 연예인분은 부담이 좀 덜했는데 일반적인 그런 경우에는 압수수색이나 구속 수사 같은 게 원칙적으로 보장이 되지 않기 때문에 더 부담이 클 수밖에 없는 것 같습니다.

◇ 김현정> 왜 이 정도로 협박하고 그러면 그 집에 들어가서 압수수색 해서 그거 영상물 가지고 와야 되는 거 아니에요? 핸드폰에 있으면 핸드폰을 수거한다든지 PC를 가지고 와야 되는 것 아닙니까?

◆ 리아> 이 정도로 이렇게 이 문제가 사회의 집중을 받기 전까지는 이게 일방적인 협박처럼 처리가 되는 경우도 있었던 거예요. 그러면 경찰이 가해자에게 '언제 와서 수사 받으라.'고 연락을 하잖아요? 그러면 가해자가 더 앙심을 품고 돌발적인 행동을 할 수 있게 되는 거죠. 유포 협박의 특성을 고려해서 제도적으로 '압수수색, 구속 수사 보장한다.' 이런 식으로 원칙이 세워져야 된다고 봅니다.

◇ 김현정> 그러면 무고한 사람이 또 역피해를 당하는 경우는 없을까요.

◆ 리아> 그런데 사실 현장에서 봤을 때는 그러한 조치들이 보장이 되어 있지 않기 때문에 많은 유포 협박 피해 경험자분들께서는 아예 이제 제도 도움을 받지조차 못해요. 유포되는 것 자체가 너무나도 큰 타격으로 다가오는 사회이다 보니까 그냥 이제 알아서 해결을 하려고 하시거나 다른 방법을 찾아보시다가 더 피해를 입으신 경우도 있거든요.

◇ 김현정> 합의금 가지고 협박한다든지. '합의금 얼마 줘.' 이러면 그러면 그거 갖고 돈 보내면 또 그다음에 또 협박을 하면서 또 돈 뜯어내고 이런 식으로 2차, 3차 피해.

◆ 리아> 네. 그리고 단순 괴롭힘 같은 것도 있는데 '내가 네 영상을 가지고 있으니까 내 연락을 받아라. 내 연락을 받고 몇 분 내에 답장 없으면 바로 유포한다.' 그런 식으로 며칠을 계속해서 보내게 되는 거죠.

◇ 김현정> 신고 하면 나 버튼 바로 누를 거야. 이러니까 신고도 못 하고.

◆ 리아> 네.

◇ 김현정> 성관계 동영상 가지고 협박했을 경우에 일반 협박과 똑같은 처벌이 이루어진다는 얘기는 방금 전에 해 주셨는데 유포했을 때의 처벌은 어떻게 됩니까?

◆ 리아> 원유포자는 성폭력 처벌법으로 처벌이 가능한데요. 그런데 2차 유포자의 경우는 성폭력 처벌법에 잘 포함되지 않는 경우가 많아서 정보통신망법으로 처벌을 하게 되는데 그런데 이때는 피해 촬영물이 성폭력 영상이 아니라 음란물로만 단순히 보게 되는 거죠. 그래서 여태까지 피해 경험자가 이런 2차 유포자를 신고하기 위해서는 내 영상이 음란하다라는 것을 증명하기 위해서 자신의 성기를 캡처해서 증거로 제출을 해야 된다든가 하는 비합리적인 문제들이 있었습니다. 그렇기 때문에 저희는 이것도 다 성폭력 처벌법으로 수사하고 처벌 가능하게 해야 한다라고 주장을 하고 있습니다.

◇ 김현정> 그렇군요, 그렇군요. 구하라 씨 사례가 지금 화제가 되고 있는데 일반인들 사이에서 이런 리벤지 포르노 범죄가 횡행하고 있단 얘기잖아요? 어떤 사례들 상담하면서 보셨어요?

◆ 리아> 앞서 말씀드린 것처럼 피해자의 일상을 다 조종하려고 하거나 아니면 다시 나랑 어떤 성적인 관계를 맺어달라라고 협박하는 경우도 많았고요. 특히 아동, 청소년의 경우에는 어리고 법에 관한 경험이 덜하잖아요. 그렇다는 점을 이용해서 선생님이나 부모에게 유포하겠다라고 하면 어린 분들은 굉장히 그 공포를 크게 느낍니다.

◇ 김현정> '학교에 유포할 거야, 부모한테 일러버릴 거야.' 이러는 순간 얘기를 못 하게 되는 상황이 벌어지는 거군요?

◆ 리아> 그렇게 해서 성매매을 시키거나 아니면 실제로 오프라인 공간에서 성폭력을 가하거나 그런 식으로 2차 범죄로 연결되는 경우가 있었습니다.

◇ 김현정> 지금 구하라 씨 전 남자 친구 측에서는요. '성관계 동영상은 내가 찍자고 한 게 아니라 구하라 씨가 찍자고 제안해서 찍게 된 거고 나는 이거 유포하겠다고 협박한 적이 없다.' 이런 공식 입장을 냈다는 것. 여러분한테 일단 말씀은 드립니다. 하지만 지금 정황을 보면서 판단들은 하시리라 생각은 하고요. 여기까지 말씀 듣죠, 고맙습니다.
